Alcohol in Sedan or SUV
Many people drink alcohol beverage in Limousine. But most of people don't know what is actual legality to consume alcohol beverage in limousine. there are many urban legend and conjecture in limousine industry too. You can ask question of "what is condition to make legal to drink alcohol in vehicle ?" to any chauffeur. Some driver may say "if you have divider, you can drink" Some might say "have to be Stretched limo" or "Only back seat on commercial vehicle"
Actually, California Vehicle code has 2 separate restrictions. One for passengers to prohibit to drink or possess open container in vehicle. The other one for driver or owner of vehicle to prohibit to store open container in vehicle other than trunk.
But Except Taxi cab, Bus and limousine for hire pursuant to Public Utility Code. it means you can drink alcohol in any vehicle with limousine license (aka TCP license showing on front and rear bumpers), and bus and Taxi with proper business license. Limousine doesn't have to be stretch limo. Civic or Echo can be limousine, if it operated by TCP licensee. Passengers can drink in sedan, SUV or Van if those are operated by TCP licensee. Even stretch limousine or bus, It is illegal to drink or have open container in vehicle if it doesn't have Transportation business license, Except living quarter of motor home.

Police officers don't remember all of codes especially portion of exceptions. They have too many other things to memorize. One of Police officer almost issue me a ticket for having open container on front passenger floor.
Under 21 If passengers are under 21 years old with-out accompanied by parent, legal guardian, responsible adult relative or any other adult designated by parent, We have to remove alcohol from passenger compartment of vehicle. and we need all passengers to read and sign form of affidavit downloadable below. All passengers include driver face to misdemeanor charge up to $1,000 fine. Please notify us if passengers are all under21 with no adult accompanied. It will cost too much for all of us.
